Acceptable Use Policy
Plain-language summary
Capsure is for sharing event photos — full stop. Don't upload illegal content, infringe copyright, harass anyone, spam, or attack the Service. Violations can result in content removal, account suspension, or legal action.
This Acceptable Use Policy ("AUP") is part of the Terms of Service. It applies to every person and entity that uses Capsure — Hosts, Affiliates, Guests, and visitors.
1. You must not
You must not, and you must not permit or assist any other third party, to/in:
- Break the law. Use the Service in any way that violates federal, state, local, or international law or regulation — including privacy, consumer-protection, export-control, tax, and intellectual-property laws.
- Harm children. Upload, distribute, solicit, or otherwise engage in child sexual-abuse material ("CSAM"), grooming, or any content that sexualizes minors. Capsure reports CSAM to the National Center for Missing & Exploited Children (NCMEC) and cooperates fully with law enforcement as required by 18 U.S.C. § 2258A.
- Infringe rights. Upload Content you do not have the right to upload, including Content that infringes copyright, trademark, patent, trade secret, right of publicity, privacy, or other rights. Repeat copyright infringers will be terminated under our DMCA Policy.
- Abuse, harass, threaten, or defame. Upload Content that is threatening, harassing, abusive, defamatory, obscene, sexually explicit without Host consent, hateful, or intended to incite violence or discrimination based on race, color, religion, national origin, sex, gender identity, sexual orientation, age, disability, or any other protected characteristic.
- Invade privacy. Upload Content of an identifiable person without a legal basis — including covert recordings where recording is unlawful, intimate images shared without consent, or personal information shared to harass (doxing).
- Spam, phish, or deceive. Use the Service to send unsolicited commercial communications, phish for credentials, impersonate Capsure or another person, misrepresent your affiliation, or engage in deceptive practices. Affiliates may not stuff cookies, use misleading creatives, or incentivize fraudulent clicks.
- Distribute malware. Upload files containing viruses, worms, trojans, ransomware, or other malicious code.
- Scrape or reverse engineer. Automatically scrape, crawl, or copy the Service or its data (except for crawlers that respect
robots.txtfor search indexing), reverse-engineer the Service, or attempt to derive source code. - Attack the Service. Engage in denial-of-service attacks, probing for vulnerabilities without written authorization, bypassing rate limits or authentication, or disrupting the Service for other users. Violate the U.S. Computer Fraud and Abuse Act (18 U.S.C. § 1030) and equivalent state law.
- Resell or white-label. Resell, rent, sublicense, or white-label the Service without our prior written agreement.
- Scrape or train AI on others' Content. Use the Service or any Content uploaded by other Users to train AI or ML models, create a dataset, or build a competing service.
- Export-control violations. Use the Service from any country or region subject to comprehensive U.S. sanctions or in violation of U.S. export-control laws, or while on a U.S. government restricted-party list.
2. Content standards for UGC
In addition to § 1, Content uploaded to event galleries must:
- relate to the event the Host invited you to;
- not contain nudity or sexually explicit material unless the Host has designated the event as adults-only and has consent from all people depicted;
- not contain personal information of others (phone numbers, home addresses, ID numbers) unless the subject has consented; and
- comply with any additional rules the Host posts for their event.
3. Reporting abuse
If you see Content or behavior that violates this AUP, report it to [email protected] (or [email protected] for copyright issues). Include enough information for us to locate and evaluate the content.
4. Enforcement
We may, at our sole discretion:
- remove offending Content;
- disable access to events or accounts;
- suspend or terminate accounts;
- withhold affiliate commissions;
- cooperate with law enforcement; and
- pursue civil or criminal remedies.
We are not obligated to monitor Content proactively. Decisions are made on a case-by-case basis. We maintain and enforce a repeat-infringer policy — see our DMCA Policy.
5. Safe harbor
Capsure qualifies for the statutory safe harbor under 47 U.S.C. § 230 (for user-generated content other than intellectual property) and 17 U.S.C. § 512 (for copyright, subject to DMCA compliance). Nothing in this AUP waives those protections.
6. Changes
We may update this AUP on the same notice schedule as our Terms of Service.
